Alpha Crypto Pulse

These Terms of Service ("Terms") govern your use of the Alpha Crypto Pulse mobile application and related services (collectively, "the app"). The app is operated by Christopher San-Martin, doing business as Dashpup Studios ("we," "us," "our").

By downloading, installing, or using the app, you agree to be bound by these Terms. If you do not agree, do not use the app.

Eligibility

You must be at least 18 years old to use Alpha Crypto Pulse. By using the app, you represent that you meet this age requirement and have the legal capacity to enter into these Terms in your jurisdiction.

Account Registration

To use most features of the app, you must create an account. You agree to provide accurate information when registering, keep your account credentials confidential, and notify us immediately of any unauthorized use of your account. You are responsible for all activity that occurs under your account.

We reserve the right to suspend or terminate accounts that violate these Terms, abuse the app's features, or harm other users.

Acceptable Use

You agree not to:

• Post content that is unlawful, harassing, defamatory, discriminatory, obscene, or hateful
• Impersonate another person or misrepresent your affiliation
• Post spam, pump-and-dump schemes, coordinated manipulation, or coordinated attacks on specific tokens or projects
• Scrape, reverse-engineer, or interfere with the app's technical operation
• Use the app to distribute malware, phishing links, or exploit code
• Attempt to gain unauthorized access to other accounts or private areas
• Violate any applicable law in your use of the app

Violation of these rules may result in content removal, account suspension, or permanent account termination at our sole discretion.

Cryptocurrency Promotions and Market Conduct

Users may not use Alpha Crypto Pulse to engage in fraud, market manipulation, deceptive token promotions, impersonation, or other unlawful cryptocurrency-related activity.

Users who publish promotional content, including affiliate links, referral codes, paid partnerships, or coordinated project promotions, must comply with applicable advertising, consumer protection, and financial disclosure requirements. This includes clearly disclosing material compensation or other relevant financial relationships where required by law.

Alpha Crypto Pulse does not independently verify cryptocurrency projects, user-reported profits, trading results, screenshots, or investment-related claims.

We reserve the right to remove content, restrict features, or suspend accounts where we reasonably believe activity violates these Terms or creates a risk of fraud or harm.

User-Generated Content

You retain ownership of content you submit to Alpha Crypto Pulse.

By submitting content, you grant us a non-exclusive, worldwide, royalty-free license to host, store, reproduce, display, distribute, and technically modify that content solely as reasonably necessary to operate, maintain, secure, and improve the platform. Technical modifications include compression, format conversion, generation of thumbnails or previews, and other standard processing required for the app's features.

This license ends when the content is deleted from our active systems, except to the extent copies are retained in accordance with our Privacy Policy, applicable law, or legitimate security and moderation requirements (including pinned message copies and moderation report records as described in the Privacy Policy).

You represent that you possess the rights necessary to grant this license.

You are solely responsible for the content you post. You represent that your content does not violate any third party's rights or any applicable law.

We reserve the right (but have no obligation) to remove any user-generated content that violates these Terms or that we deem harmful to the community.

Community Administrators and Moderators

Community administrators and moderators may manage discussions, enforce community rules, and restrict participation within their assigned communities.

Unless expressly identified as authorized representatives of Alpha Crypto Pulse, independent community administrators and moderators do not act on behalf of the platform operator. Statements, opinions, and cryptocurrency-related content published by independent community members or administrators are their own and do not necessarily represent the views of Alpha Crypto Pulse.

Where Alpha Crypto Pulse publishes content through channels or features clearly designated as official platform communications, those statements represent the platform operator but remain subject to the informational-only limitations described in our Crypto Disclaimer.

We reserve the right to intervene in community operations where reasonably necessary to enforce platform rules or protect users.

No Financial Advice

Alpha Crypto Pulse is an informational tool. Nothing in the app constitutes financial, investment, tax, or legal advice. See our separate Crypto Disclaimer for full details.

Subscriptions and In-App Purchases

Alpha Crypto Pulse may offer optional paid subscriptions, including subscriptions that remove advertisements or provide additional features.

Subscription prices, billing periods, and applicable terms will be displayed before purchase.

Unless otherwise stated at checkout, subscriptions automatically renew at the end of each billing period until canceled.

Users may manage or cancel subscriptions through their Apple App Store or Google Play account settings. Cancellation generally prevents future renewals but does not automatically provide a refund for the current billing period.

Refunds are subject to the applicable platform's policies and any mandatory consumer protection laws. All purchases are processed by Apple App Store or Google Play Store under their respective terms, not by Alpha Crypto Pulse directly.

We may change subscription pricing or features subject to applicable notice, consent, and platform requirements.

Intellectual Property

Alpha Crypto Pulse, including its original software, design, branding, logos, graphics, and other proprietary materials, is owned by its operator or applicable licensors and is protected by intellectual property laws.

Subject to these Terms, users receive a limited, non-exclusive, non-transferable, revocable license to access and use the app for its intended purposes.

Nothing in these Terms transfers ownership of Alpha Crypto Pulse's intellectual property to users.

Third-Party Links and Services

Alpha Crypto Pulse may contain links to third-party websites, cryptocurrency projects, exchanges, wallets, and other services.

We do not control or endorse third-party websites or services solely because they are linked through the app.

Users access third-party services at their own risk and should review their applicable terms, privacy practices, and security measures. We are not responsible for third-party content or services except to the extent required by applicable law.

Service Availability and Changes

We work to keep the app available, but we do not guarantee uninterrupted service. The app may be unavailable from time to time due to maintenance, technical issues, third-party service outages, or circumstances beyond our control.

We reserve the right to add, modify, or remove features at any time.

Changes to These Terms

We may update these Terms to reflect changes in our services, legal requirements, or business operations.

Where required by applicable law, we will provide advance notice of material changes and obtain any necessary consent. Updated Terms will identify their effective date.

Continued use of Alpha Crypto Pulse after legally effective changes may constitute acceptance of the revised Terms, except where additional affirmative consent is required.

Disclaimer of Warranties

The app is provided "as is" and "as available" without warranties of any kind, express or implied, including (without limitation) warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that the app will be error-free, that defects will be corrected, or that the app or servers that make it available are free of viruses or other harmful components.

Limitation of Liability

To the maximum extent permitted by law, in no event shall Christopher San-Martin, Dashpup Studios, or any of its affiliates, contractors, or agents be liable for any indirect, incidental, special, consequential, or punitive damages, including (without limitation) loss of profits, loss of data, loss of cryptocurrency value, loss of goodwill, service interruption, or any damages arising out of your use of or inability to use the app, even if we have been advised of the possibility of such damages.

Our total aggregate liability for all claims arising from or related to the app shall not exceed the greater of (a) the amount you have paid us in the twelve months preceding the claim, or (b) one hundred US dollars ($100.00).

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for fraud, intentional misconduct, or violations of applicable consumer protection laws to the extent such limitations are prohibited.

Indemnification

To the extent permitted by applicable law, you agree to indemnify and hold harmless Christopher San-Martin, doing business as Dashpup Studios, from third-party claims, damages, liabilities, and reasonable expenses, including attorneys' fees, arising from:

(a) content you submit to Alpha Crypto Pulse;

(b) your material violation of these Terms;

(c) your infringement of another person's intellectual property or other legal rights; or

(d) your unlawful conduct through the platform.

This obligation does not apply to the extent a claim results from our own negligence, misconduct, or violation of applicable law.

Dispute Resolution

Informal resolution first. Before filing any formal dispute, you agree to contact us at support@alphacryptopulse.com and attempt to resolve the matter informally for at least 30 days.

Small claims court. You may bring an individual action in small claims court if the dispute qualifies for small claims jurisdiction.

Binding arbitration. Except for disputes eligible for small claims court or claims that cannot legally be subjected to arbitration, disputes arising from these Terms or use of Alpha Crypto Pulse shall be resolved through binding individual arbitration administered by the American Arbitration Association under its applicable Consumer Arbitration Rules.

Arbitration may be conducted remotely, by telephone, or through written submissions where permitted by the applicable rules. Any required in-person proceedings will take place at a location determined in accordance with those rules and applicable law.

Arbitration fees and costs will be allocated in accordance with the applicable Consumer Arbitration Rules and governing law.

Nothing in this section prevents either party from seeking relief from a government agency or exercising rights that cannot legally be waived.

No class actions. You and we agree that disputes may be brought only on an individual basis and not as a plaintiff or class member in any purported class, consolidated, or representative action. If a court or arbitrator determines that this class-action waiver is unenforceable with respect to a particular claim, that claim shall be severed and proceed in a court of competent jurisdiction while all other claims remain subject to arbitration.

Governing law. These Terms are governed by the laws of the State of Connecticut, without regard to conflict-of-law principles.

Account Suspension and Termination

We may suspend, restrict, or terminate accounts where reasonably necessary to enforce these Terms, protect other users, prevent fraud, maintain platform security, comply with legal obligations, or protect the integrity of our services.

We may also discontinue accounts or services for legitimate operational reasons.

Where reasonably practicable, we may provide notice of significant account restrictions or termination, except where doing so would compromise security, legal compliance, or other legitimate interests.

You may stop using the app and delete your account at any time from within the app's settings.

Account termination does not automatically cancel subscriptions managed through Apple or Google. Users remain responsible for managing subscriptions through the applicable platform. Any refund rights remain subject to applicable law and platform policies.

Sections of these Terms that by their nature should survive termination (including Limitation of Liability, Indemnification, Intellectual Property, and Dispute Resolution) survive.

Entire Agreement

These Terms, together with the Privacy Policy and Crypto Disclaimer, constitute the entire agreement between you and Alpha Crypto Pulse regarding your use of the app.
